Main implications

The only amendment to the act was a definition of the type of stay required for naturalisation, which was further modified. Polish citizenship could be acquired by a foreigner upon his or her request, provided he or she had been residing in Poland for at least five years on the basis of a permit to settlement in Poland (zezwolenie na osiedlenie się) (in force since 2000), or on a permit as a long-term resident of the European Community (zezwolenie na pobyt rezydenta długoterminowego Wspólnot Europejskich), or on a permanent residence permit for the Republic of Poland (zezwolenie na pobyt). The above requirements regarding the type of stay also applied for the procedure for acquiring Polish citizenship by marriage [1].

[1] Thus, a foreigner who had been married to a Polish citizen for at least three years could acquire Polish citizenship if he or she had one of the following permit types: a permit to settle in the territory of the Republic of Poland, a permit as a long-term resident of the European Community, or a permanent residence permit for the Republic of Poland.
